The City Suit Against Las Campanas Limited Partnership Is Insufficient

We don’t yet know the outcome of the water suit against Las Campanas Limited Partnership (LCLP) by the City and County of Santa Fe but at a pre-trial hearing 9/12/03 we learned that the lawyers will certainly win!

Mark Sheridan representing the City informed Judge Hall that the trial will take 8-10 days and the lawyer for LCLP said that she planned to call 55 witnesses! Judge Hall was taken aback at these extravagant plans and said in effect that he wasn’t having any of it and told the lawyers to curb their schemes.

How much is Mark Sheridan and his firm charging the City for their representation that because of its limited reach and therefore regardless of the outcome will leave LCLP still in possession of an enormous quantity of City Buckman well water for its private golf courses located outside of the city limits and continuing to pay only a fraction of what all other water customers in the City are paying for water?

The only equitable resolution to this water issue for residents of Santa Fe is the complete invalidation of the Lease of Water Facilities and an enterprising lawyer should be able to attain this goal. Admittedly though Mayor Delgado and the City Council who have continually been under the sway of LCLP for many years would unlikely support such an effort unless an aroused citizenry demands it.
